A lawyer and his four children will be tried next week in the Provincial Court of Alicante as the perpetrator and accomplices, respectively, of a crime of misappropriation allegedly committed against a woman suffering from cognitive impairment.
According to the Public Prosecutor's indictment, the events occurred on March 22, 2017, when the main defendant, who managed the victim's assetsHe went with her to a bank in Benissa.
During that visit to the branch, the woman made four bank transfers of 20.000 euros each, which means a total of 80.000 EurosThe money was deposited into the bank accounts of each of the lawyer's children, with the description appearing in all transactions. "Christmas bonus", as detailed in the public prosecution.
The prosecution maintains that the woman had diminished ability to control economy and that he was also not in a condition to to give valid consent to make provisions of that entity regarding its assets.
The Public Prosecutor's Office believes that the lawyer, taking advantage of his position as administrator, and his children, as direct beneficiaries of the transfers, participated in the alleged misappropriation. For these acts, the prosecution requests Two years in prison for the lawyer, to whom he attributes the authorship of the crime.
It also asks one year in prison for each of his four children, considered necessary collaborators in the execution of the investigated banking operations.
