«The need for a generational change in town councils. What happened after the Baby Boom?

OPINION

On April 3, 1979, the first democratic municipal elections will be held after almost any period of Francoism, patiment and dictatorship. These elections come preceded by the general elections of 1977 and by an intense dynamic political own moments of lust, hope and change. The objective was clear: to achieve a transition to democracy without the possibility of return.

The town councils, the local administrations closest to the people, are committed to consolidating democracy, have completely renewed some of the organized municipal administrations and faced with people affected by the Franco regime, the figure of the mayor or mayors became a democratic representative triat lliurement for the citizenship in universal suffrage. With the partial retirement approved last July for the workforce, the City Councils recommend making the old workforce more flexible, favoring generational refill and opening the Local Administration labor market to the young people of our municipalities and facilitating the transmission of veteran public employment benefits to the new personnel who enter. Furthermore, there was no economic increase in the amount allocated to the dismissal of personnel from the municipal budgets, the same in Chapter 1, since the City Council only pays the proportional part of the sum corresponding to the reduced working hours and the other part complements the Social Security retirement pension. Furthermore, by rejuvenating the workforce, there has even been an economic benefit in the form of no longer having to pay three years or a horizontal professional career, but evidently the new incorporations faced have not generated the right to access these remunerations.

But all the Comissions Obreres are not completely satisfied because today only the labor force can access this type of retirement, for which it is currently lluitant so that this possibility also remains accessible to civil servants, who follow a rule for any public employee, in eixe sentit remember that the article 67.4 of the Basic Statute of Public Employment will reconèixer the right of partial retirement of civil servants and public servants in establishing that “partial retirement will proceed, at the request of the interest, as long as the civil servant meets the requirements and conditions established in the Regime of Social Security that remains applicable.”

It is certain that in principle various Superior Courts of Justice will recognize this possibility, but later the interpretive criterion will change that unless there is a regulatory development, proper and specific for the civil servant, it would not be possible to access partial retirement, and now the Supreme Court will finally be established on March 11, 2013. Furthermore, Royal Decree Law 20/2012 on measures to ensure press stability and the promotion of competitiveness will repeal art. 67.4 of the EBEP, definitively eliminating this retirement modality for civil servants.

Ara has to press in this sense also mitjançant the compromises signed by the Government of the State with the Agreement Marc by the Millora de l'Ocupació Pública and the Servei a la Ciutadania signed at the end of the pass and which ends in 2028, in which from CCOO we will achieve including various historical demands that will modernize and improve ostensibly the quality and effectiveness dels public services, in this case of the Local Administration.
